US Judge Mandates Freedom of Abrego Garcia from ICE Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer human smuggling charges, he was held in federal custody.
In her order, the judge pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
